STATE SPECIFIC REQUIREMENTS
Alaska accepts electronic Resident License applications for individual and individual in a firm applicants and business entities for both major and limited lines of authority.
RL
- All application fees are nonrefundable pursuant to 3 AAC 23.31.010
- Applicants must submit an FBI FD 258 fingerprint card to the Alaska Division of Insurance with $54.25 Fingerprint Card evaluation fee made payable to the State of Alaska.
- All Applicants – Must Include Business Fax number in application.
- Applicant must be 18 years old or older as determined from the applicant’s Date of Birth.
- Applicants licensed as an insurance producer in another state who moves to this state shall make application within ninety (90) days of cancellation of the previous resident license
- Must pass the pre-license examination(s) for license classes of producer, adjuster, surplus lines, and limited lines title, credit, and bail bond authority.
- Non-Citizen of U.S. must provide employment authorization document or permanent resident card Note: Federal law requires employment authorization.
- If all filing requirements are not met within four (4) months from the date your application is filed, the application will be considered withdrawn and a complete new application, including new application fees will be required pursuant to AS 21.27.020(g)
- Applicant applying for a limited line license can only hold a single LOA
Types:
- Individual - a person that does not represent or is not affiliated with a business entity (firm)
- Individual in a firm - a person that represents or is affiliated with a business entity (firm)
- Designated Responsible Person (Compliance Officer) - the individual designated by the business entity (firm) that is responsible for the firm's compliance with the laws and regulations for Alaska
Business Entity applicants – Must be a Legal Business Type.
- 1 - Partnership
- 2 – Limited Liability Company
- 3 – Sole Proprietorship
- 4 – Limited Liability Partnership
- 5 – Corporation
- Individuals in a firm – If an Insurance Agency Affiliation is entered, the affiliation must be actively licensed in AK.
- Designated Responsible Person (Compliance Officer) - The business entity the compliance officer represents is required to submit the Business Entity Uniform Application concurrent with the individual application for the compliance officer
- Designated Responsible Person (Compliance Officer) is required to hold an active license and cumulatively hold all lines of authority requested on the application.
- Business Entities - The designated responsible producer (compliance officer) is also required to submit the Individual Uniform Application for Producer -Compliance Officer.
- Business Entities - The compliance officer must be qualified for all lines of authority for which the business entity is seeking licensure.
- Variable Life and Variable Annuities: Question #3 on the Uniform Application must be completed.
- All Adjusters must have at least 6 months active working experience within last 2 years
- All Surplus Lines Brokers must hold a property/casualty producer license.
- Reinstatement of a license will occur if:
- Expiration date is > 1 day and up to 730 days
- License is NOT active
- Use the application to reinstate
- Reinstatement due to lapse for nonpayment of renewal fees will result in late penalty fees of $100 if 1-60 days late; and $200 over 61 days late in addition to renewal fees and Business Transaction Form 08-270
- Licenses will be issued with an expiration date determined by date of birth:
- If you were born in an even numbered year, your license will expire on your birthday in an even numbered year
- If you were born in an odd numbered year, your license will expire on your birthday in an odd numbered year
Violation of the following Resident Original rules will result in a declined response.
- The applicant is not 18 years of age.
- Variable annuity and Variable Life Applicants must provide their CRD#/FINRA #.
- Surplus Lines Brokers must hold an active PC Producer.
- Business Fax number on all applications is required/mandatory.
- If applicant selects Producer – Individual in a Firm or Producer - Compliance Officer the application must have at least one affiliation.
- Applicant for Title – Individual in a Firm must not hold any other active license class
RLR
- All Applicants – Electronic renewals will be available only up to 60 days prior to the renewal date.
- All Applicants – Any changes to the renewal must be made directly with the state DOI.
- All Applicants – You may renew a license if you hold multiple classes (example: Producer and Surplus Lines broker) or types (example: Individual and Individual in a Firm)
- All Applicants – Alaska Resident must renewal all producer license types currently held by the applicant. Partial renewals are not allowed
- An Applicants subject to continuing education requirements must submit the Continuing Education report Form (http://www.commerce.state.ak.us/insurance/pub/ce-rpt3writeto.pdf )
- All Applicants – If license identifies that administrative action has been taken that has not been previously report to this state or the license has had a criminal conviction or been charged with a crime, a statement of the circumstances and copies of the court documents must be filed for review. Administrative actions require the licensee to submit copies of the action or file the information through NIPR.com (warehouse of actions) for staff review and approval.
- Individual in a firm – If an insurance agency affiliation is not reflected, your renewal will be declined and renewals must be made directly with the state DOI
- Designated Responsible Person (Compliance Officer): If an insurance agency affiliation is not reflected, your renewal will be declined and renewal must be made directly with the state DOI
- Business Entities (Firm): Please confirm through Producer Database or state look up page ( http://www.commerce.state.ak.us/insurance/apps/producersearch/InsLicStart.cfm ) that each Designated Responsible License Producer (Compliance Officer) holds an active license in AK and the list of compliance officers covers the authorizes required on the business application. If the compliance officer does not currently hold a license in AK, the business entity must submit a change through the state DOI.
Violation of the following Resident Renewal rules will result in a decline response:
- Applicant must hold an active renewable license in AK.
- Producer Compliance Officer and Individual in Firm applicants must NOT hold MORE lines of authority than each of the Business Entities supplied.
- Compliance Officer Individual (class Producer-Compliance Officer) and Individual in Firm (Producer-Individual Firm with No Affiliations) applicants must have at least one line of authority as the Business Entity supplied.
- Business Fax Number is required
- Individuals in a firm and Compliance Officer Individual must reflect an active insurance agency affiliation.
