STATE SPECIFIC REQUIREMENTS
- All applicants:
- Applicants who provide an affirmative answer to any of the background
questions should fax requested documentation to the Insurance Licensing
Section, at (602) 364-4460.
- Applications requesting Variable Life/Variable Annuity authority must
include the applicant’s CRD number when entering application
information online.
- Current trade names must be reported to the Department. Trade names must also be filed with the Arizona Secretary of State (www.sosaz.com). Aliases, DBA's, trade names, maiden names etc that were used in the past but are not currently being used are not required to be reported to the Department.
- Business Entities:
Business entities may also need to register with the Arizona Corporation
Commission (www.cc.state.az.us) or the Arizona Secretary of State (www.sosaz.com)
to lawfully operate a business in Arizona. Other requirements for operating
a business in Arizona may apply.
- Sole Proprietorship – Sole Proprietorships are not licensed as
business entities in Arizona. An individual may file an Assumed Name
Certificate (Form L-193) to create a “doing business as” name.
- Designated Producer(s) are required to hold an Arizona license
(resident or non-res). The Designated Producer(s) must hold lines of
authority being requested by the Business Entity.
- Your Rights and Responsibilities – Licensing Time Frames: The
Administrative Completeness Review Period (“ACRP”) for your application
is 120 days pursuant to Arizona Revised Statutes Section 41-1071 et seq.,
and Arizona Administrative Code R20-6-708. The ACRP is the time within which
the Arizona Department of Insurance must determine whether you have
submitted all the information required in the application. The ACRP is
suspended if an application does not contain all information required to be
submitted. The application that you complete online may represent only a
portion of information required for a complete license application. After
submitting your electronic application, you will receive e-mail from the
NIPR that tells you either that the license application has been accepted by
Arizona or that additional information is required before the application
can be accepted.
- If the application is accepted by Arizona, the ACRP is deemed completed
and the Department must make a substantive decision concerning your license
application within 60 days after the close of the ACRP. Generally, once a
license application is accepted (and not deferred), a license is issued
within a couple business days. You can verify that a license has been issued
by looking up information about the license on Arizona’s Internet web site
(www.id.state.az.us). The license certificate will be sent to the mailing
address you furnish on the application.
- If additional information is required (for example, if the application is
deferred), the ACRP will be immediately suspended, and the Insurance
Licensing Section must receive a response to each specified deficiency or
request for additional information within 60 days after the date of the
e-mail you receive from the NIPR. Please include the NRL transaction
number in all written correspondence to the Department. If the Insurance
Licensing Section does not receive your response to each specified
deficiency or request for additional information within 60 days, your
application will be deemed withdrawn, the Department shall not be required
to take any further action with respect to it, and your non-refundable fees
will be forfeited.
- Under the following conditions, you may be required to provide additional
information to the Arizona Department of Insurance before your application
can be approved:
- There has been an administrative action imposed against an insurance
license in any jurisdiction;
- You have responded in the affirmative to a background question on the
license application;
- You intend to operate under an assumed name, for which an assumed name
certificate must be filed with the Department;
- Your application is missing information required by Arizona, or your
application appears to contain an entry that is not valid for Arizona.
State fees will not be collected by NIPR (on behalf of AZ) when a transaction is
declined according to AZ business rules. Transaction fees and processing fees
will still apply. Violation of the following rules will result in a decline
response.
- Applicant must not have an inactive Non Resident
license in AZ.
- Individual applicants - Applicant must be 18
years old or older as determined from the applicant’s Date of Birth.
- Variable Products applicants must already hold the Life loa in NR state,
or must apply for it at the same time they apply for Variable Contracts.
